Terms & Conditions of Sale

1. Seller and contract

The seller is KUDO Canarias S.L., with address at Carr. Gral. Puerto de Santiago, 28, 38683 Santiago del Teide, Santa Cruz de Tenerife. Contact: contact@kudo-rent.com, +34 603 507 549. The contract is concluded when we accept your order (e.g. by confirmation email).

2. Products and prices

Product descriptions and prices are as shown on the Site at the time of order. We reserve the right to correct errors and to limit quantities. Prices include applicable Spanish VAT unless otherwise stated. You pay the price valid at the time your order is placed.

3. Delivery / pickup

Our shop operates on a pickup-only basis at our office: Av. Quinto Centenario, 26, 38683 Puerto de Santiago, Santa Cruz de Tenerife. We will inform you when your order is ready for collection. You are responsible for collecting the goods within the period we specify. Risk passes to you when you collect the goods.

4. Payment

Payment is due as indicated at checkout. We accept the payment methods shown on the Site. You must provide correct payment details. In the event of non-payment or fraud we may cancel the order.

5. Right of withdrawal (EU consumers)

If you are a consumer in the EU, you have the right to withdraw from the contract within 14 days of the day you (or a person you nominate) receive the goods, without giving a reason. To exercise this right you must inform us clearly (e.g. by email to contact@kudo-rent.com) before the 14-day period expires. You must return the goods without undue delay and in any event within 14 days of notifying us. We will refund the price and standard delivery costs (if any) without undue delay, and in any event within 14 days of receiving the returned goods. We may withhold the refund until we have received the goods. You are liable for any diminished value of the goods resulting from handling beyond what is necessary to establish their nature, characteristics and functioning. For certain goods (e.g. sealed items that are unsealed after delivery), the right of withdrawal may be lost where the seal has been broken.

6. Warranty and defects

Goods must conform to the contract. You have the legal rights under Spanish and EU law (e.g. Royal Legislative Decree 1/2007) to have goods repaired or replaced, or to a price reduction or rescission, where goods are not in conformity. These rights are in addition to any commercial warranty we offer. Please contact us for returns or warranty claims.

7. Liability

We are not liable for indirect or consequential losses, or for losses arising from your use of the goods (except where we have breached the contract or the law). Our liability is limited to the price of the relevant order, except where mandatory law provides otherwise.

8. General

These terms are governed by the laws of Spain. For consumers, mandatory consumer protection rules of your country of residence may apply. Disputes may be submitted to the courts of your place of residence or to the courts of Santa Cruz de Tenerife. You may also use the EU Online Dispute Resolution platform.
